Job Title: Litigation Assistant

Type of Position: Full time

Hours: M-F 9-5 pm; flexible

Pay: $22.00 - $32.00

Job Description:

  • Prepare ancillary documents to file complaints (Summons, Civil Case Cover Sheet, jury fees...

  • File actual complaint with Oncall

  • Send for service of all Defendants after filing comes back from court

  • Run TLOs on Defendants and stay in touch with Oncall to offer new addresses if cannot reach Defendant to serve 

  • Propound initial discovery on all Parties

  • during COVID - work with reception to have the discovery mailed out, if necessary 

  • Prepare and send supplemental discovery when needed

  • at the direction of attorneys 

  • Save all mail from the daily mail email from reception and from the emails attorneys forward to litigation assistant (during COVID a lot of things are being served via email from Defense)

  • Maintain, organize and sort all files/send for shredding/closing files (in office task, not applicable during COVID)

  • Scanning documents/old files prepare for shredding (in office task, not applicable during COVID)

  • Ensure that consistent naming system is followed when saving documents to files 

  • Review refer out mail, save it to the appropriate files 

  • Escalate issues (motions) to the attorneys in litigation

  • Check if refer out attorney is listed on the proof of service of documents you are saving, if not, immediately email the documents to the refer out attorney listed in ACT and confirm that they received it and will attend to the matter. 

  • Print and save faxes to appropriate folder on server 

  • Send deposition transcripts to clients for review and signature.  Make sure we have signed signature pages back and submit to defense counsel.

  • Request electronic copy of the transcript or the attorneys will forward it to litigation assistant when received. 

  • Make sure to save a copy of the electronic copy to the file 

  • When deposition transcripts come in, obtain digital copy of transcripts and save to file (in office task, does not apply during COVID since all transcripts should be handled electronically)

  • Provide status update to medical providers as needed (form/call) 

  • Monthly Review cases to see if we got discovery responses and send letters to defense counsel following up on our initial discovery if no discovery responses received.

  • Pre-Suit calls

  • OnCall filing - backup
