Job Title: Corporate Counsel II - Commercial Contracts, Marketing, IP

Location: Hybrid role based in Seattle, WA (Tuesdays and Wednesdays on-site) or Atlanta, GA. Remote work available for additional days.

Job Overview

We are seeking an accomplished and proactive attorney to join our esteemed commercial legal team. This pivotal role involves providing comprehensive legal support on contract review and negotiation, marketing and brand-related guidance, and management of our intellectual property portfolio. The successful candidate will demonstrate exceptional relationship-building abilities, superior organizational skills, and a robust track record of addressing regulatory matters across diverse professional entities, states, and federal agencies.

Key Responsibilities

  • Draft, review, and negotiate a variety of commercial agreements.
  • Offer ongoing legal support to our brand, marketing, communications, and design teams concerning materials such as social media content, press releases, and advertising campaigns.
  • Manage our trademark and patent portfolios while liaising effectively with external counsel and subject matter experts.
  • Advise on federal laws regarding advertising and consumer protection, including CAN-SPAM and TCPA compliance.
  • Tackle fair housing issues related to marketing and advertising initiatives.
  • Keep updated on applicable real estate advertising regulations at state and provincial levels, as well as guidelines set by multiple listing services and the National Association of Realtors.
  • Address ethics, regulatory, and Better Business Bureau complaints regarding advertisements.
  • Provide training to agents on advertising compliance and collaborate with the design team to create user-friendly and compliant templates.
  • Develop and maintain internal resources such as playbooks and surveys to enhance the efficiency of advertising, marketing, and intellectual property-related advice.
  • Supervise and guide the regulatory compliance of our marketing, products, and services under RESPA.
  • Potentially expand support to additional areas, including product counseling and privacy matters.

Required Skills

  • 5-7 years of experience in providing legal support in fast-paced environments, with a minimum of 3 years in-house experience, preferably within a technology-focused company.
  • Juris Doctor (JD) or LLM, with a valid license to practice in at least one state.
  • Deep understanding of laws pertaining to consumer protection, advertising, fair housing, and marketing practices.
  • Proven experience drafting and negotiating various commercial agreements, including technology vendor contracts.
  • Strong knowledge of data privacy and security as it relates to commercial technology agreements.
  • Prior experience with trademark and patent management.
  • Excellent written and verbal communication skills, with an aptitude for distilling complex legal concepts into actionable business guidance.
  • Exceptional organizational abilities, reading comprehension, and attention to detail.
  • Proven time management skills with a history of prioritizing tasks based on business significance.
  • Collaborative and creative team player, eager to work alongside legal and business stakeholders to address challenging issues.
  • Familiarity with real estate brokerage law is advantageous but not mandatory.

Qualifications

  • Minimum of 5 years of relevant legal experience, including at least 3 years within an in-house legal team.
  • Substantial expertise in consumer protection and advertising law.
  • Proven track record in drafting and negotiating commercial agreements.
  • Comprehensive knowledge of data privacy and security principles.
